Terms of Service

Landscaping service policies, property access, and guarantee terms

This website is provided by Green Haven Landscaping for informational purposes about our landscaping services. By accessing and using this website, you agree to these terms and conditions.

Property Access & Liability

Landscaping services involve access to private property. Before beginning any project, we will conduct a site walkthrough to document existing conditions. You are responsible for disclosing any known underground utilities, irrigation systems, or other property features that may affect our work. While we take every precaution, we are not liable for damage to undisclosed underground infrastructure. All plant material and hardscape installations include a limited guarantee covering establishment failure due to our workmanship; guarantees do not cover drought, freeze damage, pest infestation, or improper care by the property owner after installation.

For ongoing maintenance services, you authorize Green Haven Landscaping and its staff to access your property on scheduled service days. Please ensure access points (gates, side yards) are unlocked on service days, and secure pets and remove obstacles from work areas before our scheduled arrival.

  • Disclose all known underground utilities, irrigation systems, invisible fence lines, and buried structures before work begins
  • Notify us of any changes to property access, gate codes, or scheduling preferences
  • Secure pets and ensure work areas are free of obstacles on service days
  • We carry general liability insurance and are properly licensed in TN

Weather & Scheduling

Landscaping is inherently weather-dependent. We reserve the right to reschedule services due to:

  • Unsafe conditions including lightning, high winds, or icy surfaces
  • Excessive rain that would cause soil damage, rutting, or unsafe equipment operation
  • Extreme heat or cold that would stress newly planted material
  • Equipment or personnel unavailability due to emergency conditions

We will notify you of any rescheduled service day as soon as possible. Rescheduled services are performed at the earliest available opportunity. Weather delays do not affect billing for subscription maintenance programs — your service is made up, not skipped.

Plant & Material Guarantees

We stand behind our installation work and provide the following guarantees on plant material and hardscape:

  • Plant material: 90-day guarantee on trees, shrubs, and perennials from date of installation, covering establishment failure due to our workmanship
  • Sod and seed: 30-day guarantee from installation, provided irrigation is in place and operated per our instructions
  • Hardscape: 2-year guarantee on workmanship for patios, retaining walls, and walkways
  • Irrigation: 1-year guarantee on parts and labor for new irrigation installations

Guarantees do not cover plant failure caused by drought, freeze damage beyond normal seasonal expectations, pest or disease infestation, vandalism, damage by others, or improper care by the property owner after installation. To make a guarantee claim, contact us with photos of the issue and your original service invoice.

Estimates & Pricing

Written estimates are provided prior to all installation and project work. While we make every effort to provide accurate estimates, final costs may vary if unforeseen site conditions are discovered (buried debris, soil conditions, drainage issues, etc.). Any changes beyond the original estimate require your authorization before proceeding.

Recurring maintenance service pricing is reviewed annually. We provide 30 days notice before any price adjustments take effect.

Ongoing Service Terms

Seasonal and annual maintenance agreements continue from year to year unless cancelled in writing. Cancellation requires 30 days written notice. For mid-season cancellations, services performed through the cancellation date will be billed at the applicable rate.

  • Maintenance programs are priced for the full season — skipping visits does not reduce billing for subscription programs
  • Additional services requested outside your program are quoted and billed separately
  • Late payments are subject to a 1.5% monthly service charge on balances over 30 days

Payment Terms

Payment is due within 15 days of invoice for project work and on a monthly basis for recurring maintenance. We accept check, major credit cards, and ACH bank transfer. For projects over $3,000, we require a 50% deposit before material orders are placed.

Limitation of Liability

In no event shall Green Haven Landscaping be liable for any indirect, incidental, or consequential damages. Our liability for any claim arising from services performed shall not exceed the amount paid for those specific services.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the state of TN, without regard to its conflict of law provisions.
